To process an encroachment request, a landowner must submit the following:

A letter requesting and describing the proposed encroachment.

Four copies of a detailed site plan that includes the following:
- Four copies of landscaping plan.

Four copies of utility plan.
- Four copies of the plan and profile, showing initial and proposed cross sections.
- The township or school district, county and state where the encroachment is requested.
- Copy of the current owner's deed and the correct name of the person or persons or organization to which license is to be issued.
- The type of equipment, if any, that will be used on Progress Energy's right of way (bulldozer, cranes, front-end loaders, etc.).
Simple encroachments might not require all the documentation listed above. For simple encroachments, please contact a Progress Energy land agent by calling the Real Estate Department at (919) 546-6205.
Upon receipt of the proper documents and your application, a Progress Energy land agent will ensure that the information contained on the application is consistent with the drawings submitted. The land agent will also check that proper clearances, both vertical and horizontal, are shown on your plans and all improvements in the right of way are identified. An investigation will be conducted to ensure that potential conflicts with other proposed projects do not exist. On occasion, an inspection by a Progress Energy representative may be necessary.
Transmission Department representatives from the following areas will review your application and drawings:
- Real Estate
- System Planning
- Transmission Construction and Maintenance
- Transmission Design
- Environmental
- Legal
Other departments may review the application if necessary. The primary objectives of the Land Use Program are to ensure the protection and preservation of Progress Energy land rights and the safety and integrity of the electrical facilities. Your application will be reviewed for compliance with the Transmission Line Rights of Way Use Guidelines. The Transmission Department may impose additional requirements not stated in the Transmission Line Right of Way Use Guidelines.
You will be notified by mail of the department's decision. If the application is denied, you will receive a letter stating the reason for the denial. If the application is approved, the applicant will be mailed the appropriate agreement. The agreement sets forth specific requirements for your approved project. Please allow 90-120 days to process your application.
